Fault of a Motorist
Cars, buses and trucks are a cyclist's worst enemy.  "Share the road" is a phrase
often not in a motorist's vocabulary. Common causes of accidents due to
motor vehicles are:
  • Failing to safely pass a cyclist
  • Unsafe turns.
  • Failing to yield the right-of-way.
  • Inattentiveness. 
  • Drunk driving.
 When a cyclist is struck by a vehicle, or the accident is caused by a driver's error, it is
important to have a police report. Often the cyclist is unable to give a statement due to
injuries, and the investigating officer is therefore only able to obtain a statement from
the driver, which is likely to be biased in the driver’s favor. Although the opinions of an
investigating officer are inadmissible to prove fault, the facts included in the
report, including statements, are admissible. Therefore, it is critical to obtain the
police report as soon as it is prepared and correct any errors or misstatements
before they can be used against you.
